Terms of service
These Terms of Use (hereinafter referred to as these “Terms of Use”) set forth the terms and conditions of use for the services (hereinafter referred to as the “Services") provided on this website by Glastonbury Limited. (hereinafter referred to as the “Company"). All registered users (hereinafter referred to as the "Registered User") and all users (hereinafter collectively referred to as the "User") of the Service are required to use the Service in accordance with these Terms of Use.
Article 1 (Application)
1. These Terms of Use shall apply to all relations between the User and the Company concerning the use of the Service.
2. In addition to these Terms of Use, the Company may establish various rules and regulations regarding the use of the Service (hereinafter referred to as "Individual Regulations"). These Individual Regulations shall constitute a part of this Agreement, regardless of the name by which they are called.
3. In the event that any provision of these Terms of Use conflicts with any provision of the Individual Regulations, unless otherwise specified in the Individual Regulations, the provisions of the Individual Regulations shall take precedence over these Terms of Use.
Article 2 (Registration)
1. The registration for the Service shall be completed when the applicant agrees to these Terms of Use and applies for registration in the manner specified by the Company, and when the Company approves the application.
2. If the Company determines that the applicant has any of the following reasons, the Company may not approve the application for registration, and shall not be obligated to disclose the reasons for such denial:
- (1) the applicant has provided false information when applying for registration;
- (2) when the application is from a person who has violated these Terms of Use;
- (3) in any other case in which the Company deems the registration of use to be inappropriate.
Article 3 (Management of User ID and Password)
1. The Registered User shall properly manage his/her user ID and password for the Service at his/her own responsibility.
2. The Registered User may not, under any circumstances, transfer or lend his/her user ID and password to a third party or share them with a third party. When a user logs in with the same combination of user ID and password as the registered information, the Company shall consider the use of the Service to be by the user who has registered the user ID.
3. The Company shall not be liable for any damage caused by the use of a user ID and password by a third party, except in the case of willful misconduct or gross negligence on our part.
Article 4 (Purchase Agreement)
1. A purchase agreement for the Service shall be formed when a user makes an application to purchase a product and is notified by the Company of the Company's acceptance of the application. Ownership of the product shall be transferred to the User when the Company delivers the product to the delivery company.
2. The Company shall cancel the purchase agreement described in the preceding paragraph without prior notice to the User if any of the following events occurs:
- (1) the user violates these Terms of Use;
- (2) when the ordered product is out of stock;
- (3) when the product delivery is not completed because the delivery address is unknown or the customer is absent for an extended period of time;
- (4) in any other case in which the Company deems that the relationship of trust between the Company and the User has been damaged;
- (5) the method of payment, delivery, cancellation of purchase orders, return of products, and other matters related to the Service shall be determined separately by the Company.
Article 5 (Returns and Exchanges)
1. In principle, we do not accept returns for the customer's convenience.
2. Size exchanges will be accepted only if all of the following requirements are met:
- (1) when an exchange is requested within seven (7) days of receipt of the merchandise;
- (2) when the product to be exchanged is in stock;
- (3) when the product must be unused.
3. In the case of an exchange for the user's convenience, the user shall bear the return shipping costs.
4. Exchanges will not be accepted in the following cases:
- (1) when the product has been used at least once;
- (2) when the product has been scratched, damaged, or soiled by the customer;
- (3) when any part of the accessories (box, string, sticker, cloth, etc.) of the product is missing or damaged;
- (4) when more than eight (8) days have passed since the product arrived.
Article 6 (Intellectual Property Rights)
The copyrights or other intellectual property rights to product photos and other content (hereinafter referred to as the "Content") provided by the Service belong to the Company, the Content providers, and other legitimate right holders, and the User may not reproduce, reprint, modify, or make any other secondary use of the Content without permission.
Article 7 (Prohibited Matters)
In using the Service, the User shall not engage in any of the following acts:
- (1) act that is a violation of laws and regulations or public order and morals;
- (2) act that is related to criminal acts;
- (3) act that infringes on copyrights, trademarks, or other intellectual property rights contained in the Service;
- (4) act of destroying or obstructing the functions of the Company's servers or network;
- (5) act of commercial use of information obtained through the Service;
- (6) act that may interfere with the operation of our services;
- (7) act of gaining or attempt to gain unauthorized access;
- (8) act of collecting or accumulating personal information of other users;
- (9) act of impersonating another user;
- (10) acts of providing benefits directly or indirectly to antisocial forces in relation to the Services;
- (11) other acts that the Company deems inappropriate.
Article 8 (Suspension of the Service, etc.)
1. The Company reserves the right to suspend or discontinue all or part of the Service without prior notice to the User for any of the following reasons:
- (1) maintenance, inspection, or updating of computer systems related to the Service;
- (2) when provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster;
- (3) in the event that computers or communication lines, etc. are shut down due to an accident;
- (4) in any other cases where the Company deems it difficult to provide the Service.
2. The Company shall not be liable for any disadvantage or damage incurred by the User or a third party due to the suspension or interruption of this service, regardless of the reason.
Article 9 (Restriction of Use and Termination of Registration)
The Company reserves the right to restrict the use of all or part of the Service or terminate a user's registration without prior notice in any of the following cases:
- (1) the User violates any of the provisions of these Terms of Use;
- (2) when any false information is found in the registration;
- (3) when the credit card the User has submitted as a means of payment is suspended;
- (4) when there is a default in payment of fees or other obligations;
- (5) when there is no response to communications from the Company for a certain period of time;
- (6) when there has been no use of the Service for a certain period of time since the last use of the Service;
- (7) in any other cases in which the Company deems the use of the Service inappropriate.
The Company shall not be liable for any damages incurred by the User as a result of actions taken by The Company in accordance with this Article.
Article 10 (Withdrawal from membership)
The User may withdraw from the Service by following the prescribed withdrawal procedure.
Article 11 (disclaimer of warranty and disclaimer of liability)
1. The Company does not warrant that the Service shall be free from defects in fact or in law (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors or bugs, or infringement of rights). The Company does not warrant that the information on this Web site is free from defects (including, but not limited to, errors, bugs, and infringements of rights).
2. The Company shall not be liable for any damages incurred by the User as a result of the Service. However, in the event that any contract between the Company and a user for the Service (including these Terms of Use) is void, the Company shall not be liable for any damages incurred by the user as stipulated in the Consumer Contract Act. However, this disclaimer does not apply if the contract between the Company and the User (including this agreement) is a consumer contract as defined in the Consumer Contract Act, but even in such a case, the Company shall not be liable for default or tort due to the negligence (excluding gross negligence) of the Company. However, even in such a case, the Company shall not be liable for any damage arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damage) among damages caused to the User due to default or tort caused by the negligence (excluding gross negligence) of the Company.
3. The Company shall not be responsible for any transactions, communications, or disputes that arise between the User and other users or third parties in connection with the Service.
Article 12 (Change of Service Contents, etc.)
The Company may change the contents of the Service or discontinue providing the Service without notice to the User, and The Company shall not be liable for any damages incurred by the User as a result of such changes.
Article 13 (Modification of Terms of Use)
The Company may change the Terms of Service at any time without notice to the User if the Company deems it necessary. In the event that the User starts using the Service after a modification of these Terms of Use, such User shall be deemed to have agreed to the modified Terms of Use.
Article 14 (Handling of Personal Information)
The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company's "Privacy Policy".
Article 15 (Notification or Communication)
Notification or communication between the User and the Company shall be made in a manner determined by the Company. Unless the User notifies us of a change according to a method separately determined by us, the Company shall assume that the currently registered contact address is valid and send notices or communications to that address, which shall be deemed to have reached the User at the time they are sent.
Article 16 (Prohibition of Assignment of Rights and Obligations)
The User may not assign his/her position under the Service Agreement or rights or obligations under the Service Agreement to a third party or offer them as security without prior written consent of the Company.
Article 17 (Governing Law and Jurisdiction)
1. These Terms of Use shall be governed by and construed in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
2. In the event of any dispute arising in connection with the Service, the court having jurisdiction over the location of the Company's head office shall be the court of exclusive jurisdiction.
